Female Genital Mutilation

Will the Minister of



WOMEN AND CHILD DEVELOPMENT be pleased to state:-


(a) whether the Government has written to heads of religious sects within India to discourage the practice of female genital mutilation;
(b) if so, the details thereof;
(c) whether the Government proposes to draft a legislation to specifically address the said issue;
(d) if so, the details thereof and if not, the reasons therefor; and
(e) the other measures taken by the Government to curb the practice?

(a) No Madam.
(b) Does not arise in view of (a) above. 
(c) There is no such proposal under consideration to draft legislation in this regard.
(d) Does not arise in view of (c) above.
(e) Necessary safeguards are already available under the Protection of Children from Sexual Offences Act, 2012, Indian Penal Code, 1860 and Criminal Procedure Code, 1973, which can be invoked for prosecution of people indulging in the practice of female genital mutilation.

Relevance 
 
The Minister for Women and Child Development issued a statement in May, 2017 that she will write to the head of the Bohra Community and ask her to edict a statement to its women to voluntarily give up Female Genital Mutilation. She also promised to make a law banning such practices. In June, 2017 she went on to claim that they have already made advisory listing provisions under the IPC and Protection of Children from Sexual Offences Act to be sent along with the letter. None of which has even been attempted as seen in the answer above. In fact, she has gone on to say in Decmber, 2017 that there is no data to show there is Female Genital Mutilation in India.
