(a) whether certain telecom service providers who did not successfully bid for the 3G spectrum in 2010 are offering 3G services in some circles;
(b) if so, the details thereof and its impact on public and Government`s revenue;
(c) whether the Government has filed an appeal in the Supreme Court against the Telecom Disputes Settlement and Appellate Tribunal`s (TDSAT) Judgement of April 2014 which favoured such service providers; and

(a)to (d) The details of telecom service providers who did not successfully bid for the 3G spectrum in 2010 and are offering 3G services by way of 3G Intra Circle Roaming agreements in some circles are placed at Annexure-I. Hon’ble Telecom Disputes Settlement and Appellate Tribunal (TDSAT) vide its judgment dated 29.04.2014 held that the said offering of 3G services by way of intra-circle 3G roaming agreements does not violate any provision of the Unified Access Service License (UASL). The Government has filed an appeal vide Civil Appeal D No. 32617 of 2014 in the Supreme Court against the Telecom Disputes Settlement and Appellate Tribunal’s (TDSAT) Judgement dated 29th April, 2014. The case is pending for adjudication before the Hon’ble Supreme Court as of now. As the matter being subjudice, its impact on public and Government’s revenue cannot be commented upon at this stage. |
