Re-examination of Disability Bill

Will the Minister of



SOCIAL JUSTICE AND EMPOWERMENT be pleased to state:-


(a) whether his Ministry has held consultations with the Ministry of Home Affairs, the Ministry of Tribal Affairs, and the Ministry of Women and Child Development to re-examine the provisions of the Rights of Persons with Disabilities Bill, 2014; 
(b) if so, the details thereof, including the amendments that have been proposed in the Bill;
(c) whether the Government proposes to dilute the welfare provisions for individuals suffering from diseases such as mental illnesses and genetically transfered diseases such as Haemophilia, Thalassemia, Sickle Cell Disease, Muscular Dystrophy, Multiple Sclerosis, by consolidating the welfare provisions for all individuals, irrespective of their disability and if so, the details thereof; (d) whether the Ministry would reconsider this proposal as it would violate India''s commitments under the United Nations Convention of the Rights of Persons with Disabilities (UNCRPD) and compromise on the quality of existing welfare measures; and 
(e) if not, the reasons therefor?

(a) & (b) The Government had introduced the Rights of Persons with Disabilities Bill (RPwD), 2014 in the Rajya Sabha on 07.02.2014 which was referred to the Parliamentary Standing Committee for examination. The Parliamentary Standing Committee submitted its report on 07.05.15. The Department of Empowerment of Persons with Disabilities has held consultations with various concerned Central Ministries/ Departments including Ministry of Home Affairs, Ministry of Tribal Affairs and Ministry of Women and Child Development to incorporate amendments in the RPwD Bill, 2014 keeping in view the recommendations of the Parliamentary Standing Committee. No final decision regarding proposed amendments in the Bill has been taken.
(c) No such proposal is under consideration at this stage.
(d) and (e) Do not arise.
