Will the Minister of



HOME AFFAIRS be pleased to state:-


(a) whether the Government proposes to enact a law to establish an effective framework for the protection and regulation of refugees in India and to consolidate the Standard Operating Procedures and executive orders;

(b) if so, the details thereof;

(c) whether the Government is likely to establish an independent, permanent Commission to look into the concerns of the asylum seekers, such as application for refugee status, determination of refugee status etc., to ensure that individuals seeking asylum on internationally recognised humanitarian grounds, are not arbitrarily rejected; and 

(d) if so, the details thereof?

(a) to (d): No Sir. India is not a signatory to the 1951 United Nations Convention on the Status of Refugees and the 1967 Protocol thereon.

There is no national law on Refugees at present. However, Government has circulated a Standard Operating Procedure w.e.f. 29-12-2011 for dealing with foreign nationals who claim to be refugees. The claim made by such foreign nationals are examined carefully and if found justified Long Term Visa(LTV) is granted which is renewable. One of the factors to be seen for grant of LTV is the general perceived condition in the home country of the people belonging to the community of the foreigner making the claim.
