Sanitary Facilities for Construction Workers

LABOUR AND EMPLOYMENT be pleased to state:-


(a)whether the Government has formulated schemes through Swachh Bharat Abhiyan to provide for access to toilets, for labourers employed in Construction industry, especially women;
(b)if so, the details thereof and if not, the reasons therefor;
(c)whether measures have been taken to provide running water supply to these toilets, if so, the details thereof; and
(d)the mechanism put in place by the Government to ensure accessible sanitary facilities for the construction workers in the country?

(a) to (d): The Government has enacted the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 to regulate the employment and conditions of service of building and other construction workers and to provide for their safety, health and welfare measures. Section 33 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 read with Rule 243 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 1998, makes it mandatory for the employer to provide sufficient latrine and urinal to the building workers, including women workers. Every latrine and urinal has to be conveniently situated and accessible to the building workers, adequately lighted and maintained in a clean and sanitary condition by the employer. The Act is enforced by the Central and State Governments in their respective spheres. The Central Government has issued a direction under Section 60 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 on 06.07.2016 to all the State Governments and UT Administrations to ensure that the above provisions of the Act are strictly enforced.
